Conservative Living Constitutionalists...oh my!

Now at first blush, many of you may react angrily at this heading. "Mark, I'm a conservative and how dare you call me a "Living Constitutionalist!"

So, before you email me with a piece of you mind, please hear me out. You might be a living constitutionalist without even knowing it and to some degree, you've been trained to think this way over most of your education and adult of life...just like I was.

So, let's begin with definitions. What is a living constitutionalist?

From the University of Chicago Law School: "A living Constitution is one that evolves, changes over time, and adapts to new circumstances, without being formally amended."

Notice some key words in this definition; "evolves;" "changes over time;" "adapts;" "new circumstances;" "without being FORMALLY AMENDED." Examined honestly, very few "conservatives" can claim to not be living constitutionalists, for example;

1. Have you voted for anyone (regardless if they're republican/democrat - conservative/progressive) that assisted in legislation that changed the Constitution without "formally amending it?" If you did, then knowingly or unknowingly, you're a living constitutionalist.

2. Have you personally advocated for a undeclared war (Article 1. Section 8) regardless? If you did, then knowingly or unknowingly, you're a living constitutionalist.

3. Do you benefit directly or indirectly from your fellow taxpayers through subsidies, grants, loans, direct aid, ect? If you do, then knowingly or unknowlingly, you're a living constitutionalist.

4. Lastly, do you view changing the national government though the lens of contemporary politics? Politics that uses deceptive terms like "invest," "protect;" "advance;" "increase?" Politics that reduces "change" to a candidate that offers you something? Politics where the only real choice seems to be voting for the "lessor of two evils?" All the while knowing that in the end, you still end up with evil? If you do, then knowingly or unknowingly, you're a living constitutionalist.

In reality, we're all living constitutionals now!

Some of us are trying to change this, including The Forgotten Men, Professor Kevin Gutzman, Professor Tom Woods, Professor Donald Livingston, Mike Churh and many, many others. The movement to reassert the Rule of Law over the government and the people is gaining traction...albeit it slow.

But the trek for all of us engaged in this movement always begins with coming to terms with our own ideological flaws, namely that we've been infected with a horrible anti-liberty disease called "living constitutionalistitus!" And the cure for this disease is liberty enforced by the Rule of Law, a written law, consent of the governed, and people willing to either submit to it, or FORMALLY AMEND IT.

So, will you examine your own ideology today? Can you admit to yourself that both parties are equally guilty of "evolveing, "adapting," or "changing" the Constitution over time without FORMALLY AMENDING it?

If so, join Team Liberty, take the blinders off, admit the faulty thinking and have the courage to stand up for your Inalienable Rights!
